The Federal Government’s Role in Regulating Online Gambling

One is to argue that because the federal government has the authority to prosecute a business under the Racketeer Influenced Act, that it cannot be prevented from prosecuting the operators of an illegal gambling business. Similarly, the government could impose fines and imprisonment on the operators of an illegal gambling business, if it is found to be doing so. Other arguments against this theory are that because the commercial nature of the gambling business would satisfy the Commerce Clause, there is little reason to enforce the laws against the industry.
